Parties Discussing Settlement in San Juan Water Rate Litigation

The Capistrano Dispatch is on the San Juan water rate litigation story, too.  Their latest article is here.  Noted in the article is the attempt by the parties to negotiate a settlement out of court.  A quick settlement would be in everyone’s best interests, and it is good to see the sides (which have at times seemed very adversarial towards one another) talking about a resolution.  Of course, in order for the judge to sign off on the settlement, the settlement would have to include either new evidence establishing that the tiered structure proportionately reflected the cost of water service, or would have to restructure water rates in a way that was constitutional.  Remember, constitutionality does not belong to the attorneys representing the City and the taxpayers to negotiate and bargain with.  Either the water rates are constitutional, or they aren’t.  Anyway, stay tuned.
